You don’t have to make NIL payment with post-tax income/profits. You can easily (in most situations) pay for it with pre-tax dollars as a straight forward and very ordinary business expense. Hasn’t this given boosters free reign to actively recruit players? Shouldn’t all players have business agents or attorneys to properly market themselves, make sure they have binding agreements and are not being taken advantage of?
